Issue of NOC for removing the vehicle to other state


As per section 48 of  Motor Vehicles Act “ the owner of a motor vehicle when applying for the assignment of a new registration mark under sub-section (1) of section 47, or where the transfer of a motor vehicle is to be effected in a State other than the State of its registration, the transferor of such vehicle when reporting the transfer under sub-section (1) of section 50, shall make an application in such form and in such manner as may be prescribed by the Central Government to the registering authority by which the vehicle has been registered for the issue of a certificate (hereafter in this section referred to as the no objection certificate), to the effect that the registering authority has no objection or, as the case may be, for entering the particulars of the transfer of ownership in the certificate of registration”.



The application for no objection certificate has to be filed in triplicate in form number 28. Special care has to be taken to clearly mention the designation and address of the authority to whom the NOC has to be sent  and pencil print of chassis number has to be affixed in the space provided for the same. NOC from the financier has to be attached if the vehicle is held under any hire purchase, lease or hypothecation agreement. The NOC from the police officer in the area of the owner’s residence as entered in the certificate of registration also has to be attached.
There is no fee for this service, but a service charge of Rs 50/- has to be remitted and the fee receipt has to be attached with the application. Attested copies of registration certificate, insurance certificate and pollution under control certificate and the original of tax receipt have to be submitted with the application.
If all the above documents are submitted the NOC will be prepared after verifying the application. If everything is found to be ok, original of the NOC will be sent to the registering authority and a copy of the NOC will be sent to the applicant. Self addressed cover with necessary stamps for sending the NOC by registered post has to be submitted by the applicant along with the application.

  1. I have a question here. I got an NOC from Kerala in 2007 and moved to Hyderabad. But due to some unforeseeable reasons haven't had a chance to go to the RTO here and complete the formalities. Now its been 6 years that I'm still riding my two wheeler with a Kerala registration. I heard that the NOC I got 6 years back is no longer valid. Please suggest a best method to get this vehicle transferred to Hyderabad.

    2. This is very rare situation. The solution i suggest here is only my opinion. You will have to contact the concerned RTO and explain your situation. He will conduct necessary enquiries and may request you to produce the vehicle for inspection. If he is satisfied about the genuineness of your request and the circumstances under which the re-registration of the vehicle at Hyderabad was delayed he may issue a letter to the Hyderabad RTO, after conducting necessary enquiries and after getting the required certificates from you, stating that there is no objection to include the vehicle there on the basis of the NOC already issued if otherwise everything is ok. The Hyderabad RTO may or may not accept this letter.This is all what I have to say. You contact the concerned RTO and ask him for help.

    5. Sir, I have purchased a vehicle from kerala very recently(jus 15 days). Now I need NOC to re-register the vehicle in TN. I have got original RC book, Original Insurance, Transfer Order form set and sign from transferor in Form 28, Triplicate. To apply for NOC can I send all the attested things along with prescribed service charge in DD, with 1 self addressed envelope and 1 transferor addresses envelope to the concerned RTO through proper registered post to obtain NOC?
      The main reason behind this is I am far away from KL RTO and I don't want to handover originals to any authority since the transfer of ownership is not effected.

  2. Sir Can you please tell me what should i do to use my vehicle in Tamil Nadu (Chennai) I own a Kerala registration vehicle and because of my job nature i have to move from Kerala to chennai. Please suggest me what are possible alternatives other than changin the number to use my Kerala vehicle in Chennai

    1. If you intent to use the vehicle in Chennai for more than 12 months, You will have to apply for changing the number. For this NOC from Kerala office where the vehicle is presently registered has to be taken.

    4. To the best of my knowledge, you can use any private vehicle in another state for a maximum of three months only. Up to three months, its considered as a visit. If plan to use the vehicle in one particular state for more than 3 months, you may be forced to pay road tax of that state.

  3. Dear Sir, I am a central government employee working in the ministry of defence. I have a vehicle with Kerala registration and I moved to Hyderabad recently.

    1. I did not know that I'll have to take an NOC and I have already moved to Hyderabad. Do I need to present my vehicle physically for inspection for obtaining an NOC in Kerala or just the original documents will suffice?
    2. After obtaining NOC from Kerala, is it mandatory for me to re-register the vehicle in AP or can I continue to use my vehicle in AP with the same Kerala registration? The problem is that being a central govt employee I will keep on changing states every three years and this process is totally cumbersome.

    1. For taking NOC from R.T.Offices in Kerala, vehicle need not be produced. But pencil print of the chassis number and no objection certificate from the local police station have to be submitted. Once you have taken the NOC, it is better that you include the vehicle in the new office and take NOC from there for your next transfer.

    1. For bringing your vehicle from Hyderabad to Kerala for using it in kerala, you will have to take NOC from Hyderabad. The procedure for getting NOC from Hyderabad is not know to me. You may get it from R.T.O, Hyderabad.   5. Hello Sir, I have a question. I have obtained an NOC on 4.4.06 for my vehicle from one of the RTO Offices in kerala to chennai. I used my vehicle there for 2 years and brought back here to kerala. Just because of lack of knowledge regarding the process i have not gone to the registering authority of chennai and didn't complete the process there. When i contacted an agent for selling this vehicle he said because this NOC remark in the RC book it is not possible to transfer ownership. But i came to know from others sources that validity of noc is 6 months only and if i have not registered there in chennai it gets automatically canceled. Kindly reply what pocedure should i follow to get my papers cleared.Thanks

    1. Since the vehicle is not included in Chennai even after seven years, it will be very difficult for you now. You will have to give an application before the officer from where the NOC was issued surrendering the NOC already received by you and explaining the circumstances which prevented you from including the vehicle there. They may contact the Chennai office to ascertain whether the vehicle was included there. Normally no reply will come for such queries as this is a very old case and there is no way to ascertain whether an outside vehicle is included in a particular office.. After two or three reminders sent by registered post, if they don't get any reply, they can cancel the NOC by getting an affidavit sworn in before a notary public undertaking you to be held responsible for any consequences that may arise in future. This is only my opinion. There is no prescribed procedure in such cases.

  7. Registration certificate, insurance certificate and pollution under certificates are the records that the owner will be having with him. He should also obtain a NOC from the concerned authority and hand it over to you. If the vehicle is having any finance, it has to be closed and necessary entries have to be made by the present registering authority. Form 29 two numbers and one copy of form 30 part 1 also has to be signed by the registered owner and handed over to you.

  9. If you take NOC from Kerala, you will have to include the bike at Bangalore R.T.Office and get a new number there. When you return you will have to take NOC from Bangalore ans re-include the vehicle here and get a new Kerala number

    1. Your question is not clear. I think you have taken NOC from Andhrapardesh to Karnataka and now want to cancel it. For this you will have to surrender the NOC and send a request to cancel the NOC. As the matter relates to Andhrapradesh, it is better that you enquire the matter in that state offices.

    My father purchased a Kerala regn vehicle in Dec 2013, under 3 years finance. He expired 2 weeks back and hence we now need to move this vehicle to Tamil Nadu urgently. The finance shall be closed only after May 2014 (1st 6 months).

    1. Is it possible to get NOC from Kerala RTO to move this vehicle to Tamil Nadu with an open finance? We just want to move the vehicle to TN, not use there till we change the regn. We intend to get the NOC now and change the registration to my cousin's name in TN RTO after closing the finance in 6 months.

    2. Do we need to bring the vehicle to Kerala RTO to get the NOC?

    3. What are the documents that we need to bring to RTO for getting the NOC? Is my father's death certificate mandatory (we'll get it after 1 week only)? Or will a FIR or PMC copy suffice?

    1. When the owner of a vehicle dies, the ownership of the vehicle has to be transferred to one of the heirs of the deceased and only after that application for NOC can be submitted. Since the owner is no more, it is better that you close the finance with the bank and proceed only after that. First of all..Thanks for giving light for so many people..Can you pls guide me as weI sir..I recently Purchased a Bullet which is Kerala reg..I want to transfer ownership & re-register it to Karnataka registration.The NOC was done on 2006..Karnataka LTT paid in 2003..The Actual owner of the Bullet has passed away years back..Got the Form 28 & NOC signed by the Owner's spouse. Now Owner's son was using the bullet all these years..He had Form28/30 duly signed by his mother i.e. Owner's spouse.. He has handed over me Form 28/30 signed doc, NOC (maybe it is lapsed now), LTT receipts and Pollution certificate only. My question is with these docments can i Transfer the ownership? Re-Register? or should I look for some more papers? or can i do it through an RTO Agent? If yes how much approximately will it cost? Your valuable advice/suggestion is awaited and highly appreciated..

    1. This is a very difficult situation. First the ownership of this vehicle has to be transferred to any of the successors of the vehicle as I have mentioned in my article on this subject.After this transfer only the vehicle can be sold to other persons and further proceedings can be taken.     I have a two wheeler-Kerala reg: and i am using it in Chennai... now they are asking for NOC and when i asked them in detail about this they said i need to get a paper from police station and RTO ..
    I actually don't know what kind of papers are this...please guide me with the procedures of getting NOC so i can ride my bike safely without any legal troubles in chennai..

    1. You contact the R.T.O of the office where you have to include the vehicle and give an application for assignment of new registration mark and for transfer of ownership/change of address. Inform him in detail the circumstances which caused the delay in submitting the application. He will conduct enquirers about the matter, call for confirmation from the office from where the NOC was issued, ask you to file necessary affidavits and take a decision considering the facts of the case and based on
      his findings. Anyhow there is no point in delaying the application further. Please do it immediately ,

    I recently shifted to Bangalore from Kochi and would request you to guide on the below:

    1). Where shall I apply for the Police Certificate? I was staying in Ponnurunni, Vytilla and my police station is Kadavanthara. Though the vehicle(2 wheeler) is registered in Kakkanad, Ernakulam, the permanent address mentioned is of Thiruvalla(my native) and temporary address is Palarivattom, Ernakulam on the vehicle's registration certificate. I am confused which police station to approach!

    2). Is there a standard format for the Police Certificate from Kerala govt. or can I submit a written application to the concerned police station?

    Thanks for sharing useful information. I have taken NOC in 2011 from Bangalore RTO and came to Pune, but didn't register my bike with Pune RTO till now. I have been transferred to Bangalore, can I cancel the NOC issued? I can't get NOC from Pune RTO too as it is not registered with them. Would the registration number change if I go back to Bangalore and do I need to pay tax again?

  22. The rules pertaining to other states are known to me. However based on my experience and knowledge i am trying to explain in my way.
    The NOC from Bangalore to Poone was taken during 2011. But the vehicle is not included at Pune till now. Now you are again transferred to Bangalore. So what you have to do is to contact the Banglore RTO authorities and explain the circumstances which lead to the present situation and request them to cancel the NOC already issued. They may do so after making some enquiries and asking you to submit a bond undertaking to be held responsible anything that may arise in future. Everything depends on Bangalore RTO's attitude. Please contact him and try to understand him the real facts and request his help. If he understands the circumstances, I think he will help you to come out of this ugly situation. RTO Pune has noting to do in this case.
    If needed you can apply for noting change of address and fresh number at RTO Pune. When that procedure is completed you can apply for fresh NOC to Bangalore. This will change the present bangalore number to a Pune number which will have to be changed again to a Bangalore number.There is no use in writing like this. You call be in my number 9605933311.   23. I think application for NOC can be filed through registered post as it is not included in the services rendered through online application system. Along with 3 form 28 you will have to submit a objection certificate certificate obtained from the local police station. Please go through keralamvd.gov.in for more details or contact the concerned R.T. office for further details. .

  25. Hi I am staying at Coonoor(Tamil Nadu). I purchased a new car from Kerala and did a temp registration from Thrissur. I wanted to Register it from Ooty. When I approached Ooty RTO, they wanted Clearance certificate from Commercial Tax dept. When I approached Commercial tax dept, they are asking to me to pay commercial tax of 14.5%. is there any way to avoid this.

    A friend of mine has a vehicle that has been registered in a different state. He needs to register it in kerala as that's where he lives. It has come to my notice that while doing so, the thrissur rto will not provide a temporary registration, and it will not be possible for him to book or attain the fancy number of his choice. Is there any way around this?
