INTERNATIONAL LICENSE

Rule 2(i) of Central Motor Vehicle Rules, 1989 defines international license as a  “ driving permit issued by a Licensing Authority in India under Chapter II of Motor Vehicle Act to an Indian National authorizing the person specified therein to drive any categories of motor vehicles as specified in form 6 A in the areas or territories of countries other than India but excluding the countries with whom there are no diplomatic relations”.

fApplication for International Driving Permit can be entertained by the licensing authorities only. Additional licensing Authorities or Assistant Licensing Authorities have no power to grant International Driving permit. So application for international driving permit has to be filed before the Regional Transport Officer who is the Licensing Authority of a region. The application shall be filed in form 4 A before the RTO within whose jurisdiction the applicant resides. The fee of issue of INDP is Rs 200.00 plus Rs 500.00.

Applicant has to produce the following documents along with the application for international permit.

1.       Valid driving license

2.       Three passport size photographs

3.       Certified copy of the passport

4.       Certified copy of Visa

5.       Document to prove the citizenship

6.       Medical certificate in form A

7.       Receipt of prescribed fee and service charge.

The applicant shall appear in person before the RTO on the date fixed by the RTO, After necessary verification and test, international driving permit will be issued. The validity of International Driving Permit shall be one year.

Fast Track Counters in Kerala

Motor vehicles department in Kerala which is striving to provide fast and better service to citizens has introduced a fast track counter in all the R.T. offices and sub R.T. offices in Kerala with a view to get the work done on selected items of work within a single visit. The applicants have to appear in person and submit the application complete in all respects and it is expected that the work will be processed immediately and the records will be returned back to the applicant in person within 30 minutes after completing all the procedures.

                Two counters in Regional Transport Offices and one counter in Sub Regional Transport Offices will be functioning as fast track counters. The selected services only will be rendered through fast track counters.

                The selected services and the requirements for each service like the forms required, the documents to be submitted etc. would be exhibited near the counter and the forms will be available in the fast track counter itself. If any forms are not available in the counter the applicant may log on to www.keralamvd.gov.in and download the required forms.

                Fast track counters at Regional Transport Office will be functioning form 10.00 am to 5.00 pm. But in Sub Regional Transport Office, these counters will be functioning from 2.00 pm to 5.00 pm.

                All activities like remittance of tax, payment of fee, cess, submission of application etc. can be done through a single counter.

                The applicants are encouraged to file application online and produce a print out at the fast track counter. They are also advised to make use of the services of ‘Akshaya’ centers for filing the application.

                The applicants who appear in person only will be entertained in fast track counters and their records will be returned back to them by hand within 30 days after completing all the procedures.

Section 55 of Motor Vehicle Act, 1988 provides that, “ where the person whose name has been specified in the certificate of registration as the person with whom the registered owner has entered into hire purchase agreement, satisfies the registering authority that  he has taken possession of the vehicle  [from the registered owner]owing to default of the registered owner under the provisions of the said agreement and the registered owner refuses to deliver the  certificate of registration or has absconded, such authority may, after giving the registered owner an opportunity to make such representation as he may wish to make (by sending to him a notice by registered post acknowledgement due at his address entered in the certificate of registration ) and notwithstanding that the certificate of registration is not produced before it, cancel the certificate of registration and issue a fresh certificate of registration in the name of the person with whom the registered owner has entered into the said agreement”.

From the above it is clear that a financier can apply for a fresh registration certificate in his name if the registered owner of the vehicle commits defaults in repaying the hire money. It also empowers the registering to issue a fresh registration certificate in the name of the financier, if it is satisfied that the vehicle was repossessed by the financier for default of hire purchase installments, notwithstanding that the certificate of registration is not surrendered.

The application for fresh registration certificate has to be made in form 36 and Rs 100.00 is the prescribed fee. On receiving the application, the registering authority conducts an enquiry about the genuineness of the application. If the registering authority is satisfied that the application for fresh registration certificate was made by the financier after repossessing the vehicle, it will sent a notice to the registered owner informing the fact that the application for fresh registration certificate is pending and asking him to make representations, if any, in this regard. After waiting for the stipulated time the registering authority will issue a fresh registration certificate to the financier after cancelling the registration certificate already issued. Normally, the objections, if any, filed by the registered owner is not considered by the authority in its merits as t there is express provision to issue fresh registration certificate. If the registered owner intends to stop the process of  the issue of fresh registration certificate he will have approach the appropriate court of law and obtain necessary orders from the court.

The validity of the fresh registration certificate issued in respect of a non transport vehicle shall be valid only for the remaining period for which the certificate cancelled would have been valid.

Vehicle registration

As per Motor Vehicle Act, 1988, no motor vehicle shall be driven any public place without valid registration. Application for registration shall be made before the Registering Authority in whose jurisdiction the applicant normally resides or has his place of business. The application shall be accompanied by the following documents:

1)      Application if form 20

2)      Sale certificate issued by the dealer in form 21

3)      Valid insurance certificate

4)      Road worthiness certificate in form 21 issued by the manufacturer

5)      Certificate in from 22  issued by the manufacturer in the case of a body built by a body builder other than the manufacturer

6)      Address proof

7)      Copy of the design approval in the case of a Semi Trailer

8)      Original sale certificate in form 21 in the case of an ex-army vehicle

9)      Temporary registration, if any

10)   Pencil print of chassis number

11)   Customs clearance certificate in the case of an imported vehicle

12)   Receipt of fee paid

      A temporary registration certificate which is normally valid for 7 days is issued to a new vehicle so as to facilitate the movement of the vehicle to the place of registration. In the case of a vehicle for which a body has to be constructed the validity of the temporary registration shall be 30 days. The application for temporary registration has to be made in form 20 and the fee for the same is Rs 50.00.

    Validity of temporary registration certificate issued to body built vehicle will be extended to another 30 days if application for the same is made before the expiry of the existing validity. Fee of extension of temporary registration is Rs 50.00. Extension of temporary registration will not be allowed for other vehicles for which no body has to be built.

                Directions were issued from this office vide circular No 20/98 that the test for LMV, two wheeler and three wheeler will be in two parts. Part I is the ground test and part II is the road test. The part I ground test for LMV shall be in H - track and in an 8 – track for two wheeler and three wheeler. The specifications of H and 8 tracks were specified in appendix A and B of the said circular.

                Due to phenomenal increase of motor vehicles on roads, the quality of driving is gaining more and more importance. It is very crucial to examine the driver’s skill and his knowledge in traffic rules thoroughly before the issue of driving license. Rule 15 of Central Motor Vehicle Rules deals with driving tests.

                With a view to improve the quality and transparency in conducting driving tests, and as a part of modernization of the department and implementation of e-governance activities the department has decided to set up Automated Driver Testing Tracks for LMV, Motor Cycles and 3 wheelers. One of such testing stations has been established and is functioning at Chevayoor, Kozhikkode.

Sub Rule (3) says that the applicant shall satisfy the person conducting the test that he is able to perform the matters prescribed in clauses (a) to (x). Clause (f) of the above sub rule read as ‘ stop and re-start the vehicle on a steep upward incline making proper use of brake or throttle and the foot brake without any rolling back, turn left and right corners correctly and make proper use of the rear view mirror before signaling’. Clause (k) read as ‘in the case of a vehicle having a reverse gear, driving the vehicle backwards, reverse it into a little opening either to the right or left under control with reasonable accuracy’. To examine the driver’s skill as specified above, a gradient track and a parking track are necessary in addition to the existing H track in the case of  LMV. Therefore the station set up Kozhikkode consists of an H - track, gradient track and parking track for conducting part I test for LMV and an 8 track for conducting part I test for two and three wheeler. The Video Analytics based monitoring system in the testing system will analyze the driving competence of the candidate objectively without human intervention and generate the recorded evidence automatically. The specifications of H -  track, gradient track and parking track for LMV is given in Annexure I and the specifications of 8 – track for two wheeler and there wheeler is given in Annexure II.

                Now for the purpose of testing the candidates in the automated track, it is decided to modify the clause 3 of the circular and the specifications of H and 8 tracks. The part I ground test for LMV shall consist of three parts namely (a) H track, (b) gradient track and (c) parking track as specified in Annexure-I. Candidates who pass the test in all the three tracks will be qualified in part I test for LMV. IF he/she fails in any of the item he/she shall be retested in that test only. If the candidate fails in test (a) he/she shall not be tested in test (b) or (c).

                In the case of two and three wheelers, the existing 8 track needs some modifications in the dimensions, so as to turn the vehicle in its minimum turning radius. Part I ground test for two and three wheelers will be in an 8-track as specified in Annexure-II.

                There is no change in part II road test specified in circular 20/98 except the items 5 and 10 in the case of LMV.

                The purpose of each test track is detailed below.           

H – Track (LMV)                                               

                The H track is for testing the ability and accuracy of a candidate to turn the vehicle left and right in forward and reverse gear in a limited space. When turning and reversing simultaneously, the front of the vehicle will swing wide and the driver should look over his shoulders for best view. This track is also intended for testing the ability in positioning of the vehicle before and after turning to the left or right.

Gradient track (LMV)

                The gradient track is for testing the ability of the driver to stop and restart the vehicle on a steep upward incline marking proper use of hand brake/accelerator, foot brake and clutch without any rolling back as specified in CMV Rule 15(k).

Parking track (LMV)

                The parking track is for testing the ability of the driver to park the vehicle in a parking area and to drive the vehicle backwards, reverse into a limited opening as specified in CMV Rule 15 (k)

8 -  Track I(Two wheeler and Three wheeler)     

                The 8 – shaped driving test yard is to assess the ability of a driver on left and right steering, sharp turning and negotiating roundabouts. The track is designed in conjunction with the minimum turning radius of motor cycles and three wheelers.

DRIVING TEST PROCEDURES      

H TRACK

1.       The candidate shall start from point A and return to point A, movement being A>B in forward gear, B>C in reverse gear, C>D in forward gear and D>A in reverse gear.

GRADIENT TRACK

1.      The applicant shall stop on the gradient within the stop lines.

2.    Re-start and drive the vehicle by using Accelerator/Hand brake, clutche and Foot brake without rolling back for more than 10 cm.

PARKING TRACK

1.      The candidate shall park the vehicle in an angular parking track by driving backwards.

8 TRACK              

1.      The candidate shall start from point A and return back to point A, movement being A>B>C>D>E>F>G>A, in forward gear.

FAIL PARAMETERS

H TRACK

1.       Vehicle goes outside the track.

2.       Vehicle touches the poles fixed on the track.

3.       Vehicle stops during the course of driving.

GRADIENT TRACK

1.        Vehicle rolls back in excess to the allowance provided.

PARIKNG TRACK

1.        Vehicle goes out of track.

8 TRACK

1              Vehicle goes outside the track.

2              The candidate puts his/her foot on the ground while driving(for 2/W)

3              The vehicle stops during the course of driving.

A red dot represents the faill parameters and would be marked in the test sheets of the candidate if he/she commits a mistake. If any fail points are marked in the test sheet, the candidate will fail in part I of the test.

CANDIDATE ENTRY PROCEDURE

Stage I    Candidate appears before the officer and submits the application for driving license.

Stage II   The officer shall check the validity and other details in the learner’s license application. (The details will be fetched from the central server of the department by bar code scanning.)

Stage III   After successful verification the officer will issue a token/queue number to the candidate.

Stage IV   The candidate shall wait in the waiting room and on calling his token number, shall proceed to the driving testing track with his vehicle.

Stage V   At the entry of the track, a red signal will be displayed. The officer shall take the photo of the candidate with his vehicle using the system camera.

Stage VI   A green signal will be displayed and the candidate can proceed to the next stage with his vehicle.

Stage VII Auto rickshaws and two wheelers shall proceed to the 8 track. Light Motor Vehicles shall proceed to H track first, then to gradient track and then to parking track.

Stage VIII   After the test is completed, the test report generated by the system shall be provided to the candidates.

                Only the candidates who have qualified in part I ground test in the respective class of vehicle will be eligible for Part II (Road) test. The above information shall be followed in all the Automated Driver Testing Tracks established/ to be established in the State. This will come into force with effect from 01-05-2013 onwards.

Adding additional classes in a driving license

A person holding a driving license for a particular class of vehicle may need another class or classes to be added to his driving license. For example a person who holds a driving to drive motorcycles may need additional classes like four wheeler or three wheeler.  If the applicant intends to take badge for driving transport vehicles, he should have completed 20 years of age and should have completed one year after taking license for light motor vehicles. Transport vehicle is a vehicle used for hire or reward. For driving a transport vehicle a badge is required. The procedure to be followed and forms and other documents required in such a situations are explained below.

As a first step the applicant has to apply for a learner’s license for the additional class of vehicle which he intends to take. There will be no learners test in the case of additional class of vehicles. Only application has to be filed and learner’s license will be issued from the office without conducting any test. Application for additional class of vehicle has to be filed in form 8. Self declaration of the applicant regarding his medical fitness  in form  1 has to be submitted in case of non transport vehicles and medical certificate  in form 1 issued by a registered medical practitioner is required if the application if for transport vehicles. Eye certificate in the prescribed form issued by an eye specialist has also to be submitted.

When learner’s license is issued the date on which the applicant has to appear for driving test will be specified in the application. On the date and time specified in the learner’s license, the applicant has to undergo for a driving test with a suitable vehicle of the class of vehicle for which the driving license is applied for. If the applicant passes in the driving test a receipt will be issued immediately and the driving license will be sent to him by registered post within a weak in the address furnished in the application.

If the applicant fails in the test, he can appear for re-test on the fifteenth day after remitting Rs50.00 as re-test fee for each class of vehicle. If the applicant fails in three successive tests he can re-appear for test only after next 60 days.

Minimum charge is Rs 15.00. The distance that can be travelled with minimum charge is 1.25 km.

In the fare list charges for additional .50 km is calculated and shown. For additional 1/16 of every kilometer fare  at the rate of 50 paisa or for  every 100 meters fare at the rate of 80 paisa has to be calculated.

For journey between 10.00 pm and 5.00 am 50 % of the normal fare charge has to be paid additionally.

If there is any complaint about excess fare collection, the  complaint has to be filed before the nearest police station or R.T.Office with details such as number of the vehicle, the journey time, the route travelled, fare collected etc.
