Transfer of ownership of the vehicle on death of the registered owner




When the registered owner of a motor vehicle dies, the person succeeding to the possession of the vehicle has to intimate the death of the registered owner to the concerned Registering/
Additional Registering Authority within 30 days of the death of the registered owner. If this is done the person succeeding to the possession of the vehicle can use the vehcile for 3 months from the date of death of the registered owner, as if the vehicle was registered in his name. Application for transfer of ownership has to be submitted in form 31 (specimen of the form is furnished below) with the following documents.
i) Attested copy of the death certificate.
2) Legal heirship certifacate or succession ceritificte or certificate of administration.
3) Consent letter signed before a notary public, by all the other legal heirs expressing their no
objection to transfer the ownership of the vehicle to the person succeeding to the
possession of the vehicle.
4) Receipt of the required fee paid at the concerned office.

On receiving the application, the concerned Registering/Additional Registering Authority will summon the applicant to appeat for a personel hearing with originals of all the documets submitted. After personal hearing and after verifying the originals of the documets produced, transfer of ownership will be effected immediatily and the records will be sent to the applicant under certificate of posting.

Assignment of new registration number for vehicles brought from other states

Transport Commissioner in a recent cirular has made the procedure very simple for assigning a new registration number to vehicles brought from other states. Applications are received either for noting change of address or for transferring the ownership of the Vehicles brought from other states. Procedure is same for both the above mentioned purposes. Documents to be submitted along with the application are furnished below.

1) Application in form 27
2) Registration certificate of the vehicle
3) No Objection certificate in form 28 obtained from the Registering Authority where the vehicle was registered.
4) Proof of addrss
5) Valid Insurance Certificate
6) Valid Pollution Under Control Certifacate
7)Two attested copies of photographs
Affidavit sworn in before a notary public
9)Application in form 33, if the application is for change of address
10) Application in form 29 ( 2 copies) and one copy of form 30 part 1 and part 2, if the appllication is for transfer of ownership
11) Receipt of the requred fee remitted at the concerned office.

On receipt of the application Joint Regional Transport Officer will verify the application in person. If he is satisfied from the verification of the application he will ask the Assistant Motor Vehicle Inspector to inspect the vehilce. After inspecting the vehicle the application will be receive in the office. On receiving the application, letters will be sent to the National Crime Research Centre to see whether the vehicle is involved in any crime and original registering will be addressed to ascertain the genuineness of the no objection certificate produced. At the same time the applicant will be called for a personal hearing. When the appllicant appears for personel hearing, his statement will be taken. New registration mark will be assigned immediately and the matter wil be intimated to the original registering authority by registered post.
