Government order regarding Auto rickshaw and tax fares - Kerala RTO

G. O. (P) No. 77/20 12frran.                                       Dated, Thiruvananthapuram, 30th November, 2012.
S. R. O. No. 830/2012.-                               WHEREAS, representations have been received byGovernment that the existing rates of hire charges of Autorickshaws and Taxis should be revised;
AND WHEREAS, the Government are satisfied that the conditions have changed since the issuance of directions in Notification issued under G. O. (P) No. 2/20111Tran. dated the 14th January, 2011 published as S. R. O. No. 3312011 in the Kerala Gazette Extraordinary No. 76 dated the  14th January, 2011, and that it is necessary to modify the directions issued to the State Transport Authority and the Regional Transport Authorities in respect of the hire charges of Autorickshaws and Taxis in the said notification;
Now, THEREFORE, in exercise of the powers conferred by clause (i) of sub-section (1) of section 67 of the Motor Vehicles Act, 1988 (Central Act 59 of 1988) and in supersession of the direction in notification issued under G. O. (P) No. 2/2011Tran. dated the 14th January, 2011 published as S. R. O. No. 33/2011 in the Kerala Gazette Extraordinary No. 76 dated the 14th January,2011, the Government of Kerala hereby issue the following directions to the State Transport Authority and the Regional Transport Authorities in the State as follows:-
DIRECTIONS
The State Transport Authority or the Regional Transport Authorities, as the
case may be, shall refix the fares of contract carriages specified in column (1) of the Schedule below, at the rates shown in the corresponding entries under column (2) thereof, namely:-

                                                                       for   a distance upto 1.25 Kilometer.

                In the case of Auto rickshaws, an additional charge at the rate of 50%           of the above rate of hire charges may be levied for journeys performed between 10 p. m. and 5 a. m. During day time, between 5 a. m. and 10 p. m., an additional charge at the rate of 50% of the charges shown in the meter in excess of the minimum charge can be levied when onward journey alone is performed and the metered charges  when return journey is also performed except in Corporation areas of Thiruvananthapuram,  Kollam,  Kochi,  Thrissur  and  Kozhikode  and  in  the major towns of Kannur, Palakkad, and Kottayam, where only the metered charges can be levied.

      The State Transport Authority or the Regional Transport Authorities as thecase may be, shall issue authenticated printed cards to the permit holders showing progression of charges beyond the standard charges leviable and the same shall be displayed in the contract carriages for convincing the passengersthe prevailing rates.
This notification shall come into force at once.

Explanatory Note

(This does not form part of the notification, but is intended to indicate its
general purport.)
Representations were received by Government from the leaders of Trade Unions connected with Auto rickshaws and Motor Cabs, requesting for revision of hire charges fixed in 2011 as per G. O. (P) No. 2/20ll/Tran. dated the 14th January, 2011 published as S.R.O. No. 33/2011 in the Kerala Gazette Extraordinary No. 76 dated the 14th January, 2011. Having regard to the conditions stipulated in sub-section (1) of section 67 of the Motor Vehicles Act, 1988 (Central Act 59 of 1988) and the hike in price of Petrol and Diesel and all other allied factors that cause the increase in the operating cost and the interim report submitted by the Justice Ramachandran Committee constituted as per G. O. (Ms.) No. 6112010/Tran. dated 19-8-2010, Government have decided to allow increase in the hire charges of Auto rickshaws and Motor Cabs.
The notification is intended to achieve the above object.



Issue of Driving License to persons holding valid driving license issued from foreign countries - Kerala RTO

CIRCULAR NO.11/2000
Sub: Motor Vehicles Act and Rules – Issue of Driving License to persons holding valid driving license issued from foreign countries-Instruction Issued.
Ref:  circular No 3/2000

As per the Circular referred above, instructions had been given regarding the procedure for issue of Driving License to those persons who are in possession of valid Driving License of foreign countries. In the above mentioned circular, it was clarified that persons in possession of valid driving license of other countries will be exempted from learner’s license and test of competence to drive, while applying for Driving License. But as per clause III of sub-section 9, persons in possession of valid Driving License issued by a competent authority of any foreign country will be exempted from the test of competence to drive while applying for Driving License. But there is no provision in the Act or Rules for exempting a person from obtaining a learner’s license while applying for a Driving License. Moreover according to Rule 14 of the C.M.V. Rules, an application for a Driving license shall be accompanied by an effective learner’s license. This invariably means that such persons should undergo and pass the learner’s test as prescribed in sub –section (5) of section 8 of Motor Vehicles Act, 1988.

            It is therefore clarified that any applicant who holds a valid driving license issued by a competent authority of any country outside India and who is desirous of applying for a Driving License in India under section 9(3) (III) has necessarily to obtain a learner’s license as per section 8 of Motor Vehicles Act read with rule 14 of Central Rules.

Circular No 3/2000 is hereby cancelled.

Receipt of the circular will be acknowledged.

Educational Institution Bus, Kerala notification

The following draft of the rules further to amend the Kerala Motor Vehicle Rules, 1989 which the Government of Kerala propose to make in exercise of the powers conferred  by sub-section (1) of section 111 of Central Motor Vehicle Act, 1988, is hereby published for general information, as required by sub-section (1) of section 212 of the said Act.
               Notice is hereby given that the said drat rules will be taken up for consideration on or after thirty days from the date of publication of this and that objections or suggestions, if any, that may be received from any person in respect of the said draft Rules on or before the time specified above will be considered by the Government. Objections or suggestions, if any, in duplicate, shall be addressed to the Secretary to Government, Transport Department, Government Secretariat, Thiruvananthapuram.
1.      Short title and commencement,- (1) These rules may be called the Kerala Motor Vehicle Amendment Rules, 2011.
    (2) They shall come into at once.
2.    Amendment of the Rules- In the Kerala Motor Vehicle Rules, 1989 after rule 291, the following rule shall be inserted, namely:-
           291A. Institution Emergency Exit in Educational Bus, -  (1) Every educational institution bus shall be provided with an emergency exit in the form a frame fixed with safety glass with dimensions on one hundred and centimeters horizontally and one hundred and twenty centimeters vertically or in the form of a door with the same dimensions hinged at the top, capable of being operated both from inside and outside.
  (2) The emergency exit shall be fitted at the rear wind screen and the words “EMERGENCY EXIT” shall be prominently inscribed in red color on a white background both inside and outside the emergency exit:
  Provided that sub-rule (1) and (2) are not applicable where there are rear doors in the educational institution bus provided by the manufacturer:
  Provided further that sub-rule (1) and (2) shall not apply to educational institution buses having wheel base less than, 300 centimeter.
  (3) Every educational Institution bus shall be provided with side windows on either sides having not less than  55 centimeter height and 70 centimeter length.
  (4) Provisions of sub-rule (1), (2) and (3) shall not so apply to an educational institution bus registered before 01-08-2007 but shall apply when its body is constructed, at any time, subsequent to the above date.
