The following draft of the rules further to amend the Kerala Motor Vehicle Rules, 1989 which the Government of Kerala propose to make in exercise of the powers conferred  by sub-section (1) of section 111 of Central Motor Vehicle Act, 1988, is hereby published for general information, as required by sub-section (1) of section 212 of the said Act.
               Notice is hereby given that the said drat rules will be taken up for consideration on or after thirty days from the date of publication of this and that objections or suggestions, if any, that may be received from any person in respect of the said draft Rules on or before the time specified above will be considered by the Government. Objections or suggestions, if any, in duplicate, shall be addressed to the Secretary to Government, Transport Department, Government Secretariat, Thiruvananthapuram.
1.      Short title and commencement,- (1) These rules may be called the Kerala Motor Vehicle Amendment Rules, 2011.
    (2) They shall come into at once.
2.    Amendment of the Rules- In the Kerala Motor Vehicle Rules, 1989 after rule 291, the following rule shall be inserted, namely:-
           291A. Institution Emergency Exit in Educational Bus, -  (1) Every educational institution bus shall be provided with an emergency exit in the form a frame fixed with safety glass with dimensions on one hundred and centimeters horizontally and one hundred and twenty centimeters vertically or in the form of a door with the same dimensions hinged at the top, capable of being operated both from inside and outside.
  (2) The emergency exit shall be fitted at the rear wind screen and the words “EMERGENCY EXIT” shall be prominently inscribed in red color on a white background both inside and outside the emergency exit:
  Provided that sub-rule (1) and (2) are not applicable where there are rear doors in the educational institution bus provided by the manufacturer:
  Provided further that sub-rule (1) and (2) shall not apply to educational institution buses having wheel base less than, 300 centimeter.
  (3) Every educational Institution bus shall be provided with side windows on either sides having not less than  55 centimeter height and 70 centimeter length.
  (4) Provisions of sub-rule (1), (2) and (3) shall not so apply to an educational institution bus registered before 01-08-2007 but shall apply when its body is constructed, at any time, subsequent to the above date.

Rule 29 of Kerala Motor Vehicle Rules, 1989 specifies that “if at any time a driving license is lost or destroyed, the holder of such license shall forthwith intimate the fact that and apply for duplicate license in form ‘DLLD’ in duplicate to the Licensing Authority having jurisdiction over the area in which he has his place of residence at that time.’
So application for duplicate license has to be filed in form DLLD before the licensing authority within whose jurisdiction the applicant is now residing. The receipt obtained after remitting the required fee of Rs 250/-(Rs 200/- being the fee for renewal of driving license and Rs 50/- being the service charge) and two passport size photographs and an affidavit signed in plain white paper will also have to be submitted by the applicant. Late fee applicable for delay for each year of delay will also have to be paid.
 If for any reason, the applicant could not appear before the licensing authority in person he can authorize another person with a proper authorization letter in and either the applicant or the authorized person will have to appear before the licensing authority with an affidavit written in a stamp paper worth Rs 50/- in the format given in the annexure I. As per the citizen’s charter of motor vehicles department the duplicate license will be sent to the applicant’s address entered in the license after five days of the personal hearing of the applicant or applicant’s authorized person by the licensing authority.

                              This license has been lost irrecoverably and I have exerted all possible efforts to trace out the license. This matter has been informed at the local police office and no information in this regard has been received from that office till date. This license has not been taken into possession by any of the authorities like police, forest, excise, motor vehicles, court or any non Governmental agencies and this license has not been pledged or mortgaged to anybody in connection with financial activities.
                              My above license was not suspended or cancelled. If the license has been traced out it will be returned by me immediately. I request that the delay in informing the fact of the loss of license may be forgiven and I also confirm that the facts stated above are true and genuine. If anything contrary to the above statement were found out in future, I agree to be held myself and by family members and my movable and immovable property responsible and the same may be made use of to make good the losses that may be caused to the department or the Government.

               SRO No………/2012  In exercise of powers conferred by clause (xii) of sub-section (2) of section 96 of Motor Vehicles Act,1988 (Central Act 59 of 1988), the Government of Kerala hereby make the following rules further to amend the Kerala Motor Vehicles Rules, 1989, the same having been previously published in Notification No.13913/B2/11/Tran dated 10th February, 2012, in the Kerala Gazette extra ordinary No. 332 dated 18th February, 2012 as required by sub-section (1) of section 212, of the said Act namely:-

RULES

1.      Short title and commencement,-  (1) These rules may be called the Kerala Motor Vehicle (Amendment) Rules, 2012.

(2)    They shall come into force at once.

2.      Amendment of the Rules,-    In the Kerala Motor Vehicle Rules,1989, after rule 153 C, the following  rule shall be inserted namely:-

“153 D conditions for the grant of permit of Educational Institution Buses,- It shall be the condition of the permit of Every Educational Institution Bus or transport bus which is used for the transportation of school children, that the holder thereof shall ensure that,-

(i)                if the vehicle used for the transportation of school children is a  hired vehicle, a board showing the words “ On School Duty” written conspicuously in blue letter on white background is exhibited at the top of the front and rear ends of the vehicle.

(ii)              the vehicle has a First-Aid Box as provided under rule 151 of Kerala Motor Vehicle Rules, 1989;

(iii)             the windows of such vehicles are fitted with horizontal grills;

(iv)             there is a for extinguisher in the vehicle;

(v)              the name and telephone number of the educational institution is written at a prominent place on the vehicle;

(vi)             the doors of such vehicles are fitted with reliable locks;

(vii)            there is ample space under the seats for keeping school bags safely;

(viii)          there is a qualified attendant in the vehicle to attend to children;
(ix)             any parent/guardian or teacher shall travel in such vehicle to ensure the safety norms;
the driver of the vehicle has an experience of at least ten years In driving and has an experience of at least five years in driving heavy vehicles;

(x)              the driver of vehicle has an experience of at least ten years in driving and has an experience of at least five years in driving heavy vehicles;

(xi)             a driver who has been challenged more than twice a year for offences like red light
                           jumping, violation of lane discipline, or allowing unauthorized person to drive is not
                           employed;
           
(xii)            a driver who has been challenged even once for the offences of over speeding, drunken driving and dangerous driving is not employed;

(xiii)          the details of those who travel in the bus are kept in the vehicle and such details contain the name of the traveller, name of the guardian, address and telephone number/mobile number for contact and said list is properly laminated;
(xiv)          the vehicle is subject to surprise checking by school authority/office bearers of Parents-Teachers Association in order to watch the behaviour/nature of services rendered by the crew of such vehicle.

Sub:- Motor Vehicles Department- Introduction of  ‘FAST TRACK COUNTER’  System
          instructions issued –Reg:-
Ref:- This office circular No 7/2008

1.      Motor Vehicles Department is in the process of providing fast and better service to citizens. In order to provide faster services it is decided to introduce FAST TRACK counter in all Regional and Sub Regional Transport Office in the State for single visit disposal of certain services. It is decided that selected services which can be delivered over the counter shall be rendered through FAST TRACK counters
2.      The following services shall be rendered through FAST TRACK counter:

       3. For effective and efficient functioning of the system following instructions are issued.
         
(i)                Two counters in Regional Transport Offices and one counter in Sub Regional transport Office may be set apart as ‘FAST TRACK’ counters. Other counters will continue to provide all services including the fast track services.
(ii)              A sign board with inscription ‘FAST TRACK COUNTER’ shall be exhibited conspicuously above earmarked counter.
(iii)             Only the identified services will be rendered through fast track counters.
(iv)             The services available through the fast track counter will be written on the sign  board mentioned above.
(v)              Defective applications shall not be accepted through the counter.
(vi)             The documents required for the services/procedure shall also be exhibited on a notice board near to the counter and the required forms will be made available at the counter.
(vii)            It shall be ensured that at least one of the officers authorized to authenticate documents ( R.T.O/Jt. R.T.O/M.V.I) is present in the office during working hours.
(viii)          In sub Regional Transport Offices, the ‘FAST TRACK COUNTER’ shall only function during afternoon hours from 2 pm to 5 pm.
(ix)             The collection through ‘FAST TRACK’ counter need be remitted to the treasury only on the next working day. Earlier circulars on this is modified to the above effect.
(x)              ‘FAST TRACK’ counter services will be rendered only if holder of the license/registered owner is present personally.
(xi)             All transactions of each individual user including submission of application, remittance of payments and fees, taxes and cess and so on will be done at the counter.
(xii)            All applicants will be encouraged to file application online and arrive at the counter with a print out.
(xiii)          The applications shall be accepted and the records shall be handed over to the applicant by hand in respect of ‘FAST TRACK’ in relaxation of orders already issued in this regard.
(xiv)          Where photographs are required, scanner or wet camera (to be supplied) will be utilized based on the applicant’s choice.
(xv)            Services of PRO in R.T.Offices  can be availed by the applicants to pre check the documents before standing in the queue.
4.      Following procedure shall be followed for rendering the services.
(i)                Applications complete in all respect with fee shall be scrutinized and verified and registered inward and receipt shall be issued at the counter by counter clerks.
(ii)              Applications shall be forwarded to the issue level officer through the system from counter. The application fee will also be sent to the issue level officer.
(iii)             After issue, the issue level officers make a noting in the file ‘issued’. In printing section, the document is printed immediately with facsimile of the issue level officer which is then sent to the Despatch Section.
(iv)             The despatch section shall hand over the documents to the applicant based on the priority number of receipt  and make entries in the despatch module
5.      The services shall be rendered within 30 minutes after the receipt of the application
6.      All are requested to follow the instructions scrupulously so as to deliver better service to the pubic. The system will be introduced with effect from30.06.2010.
7.      Receipt of this circular shall be acknowledged.
