Transfer of ownership
(1) When a registered owner or a vehicle sells his vehicle
to a person within Kerala state he has to inform this fact in form 29 to the registering
authority within whose jurisdiction the transfer is to be effected within 14
days of the transfer
( 2 )When the vehicle is sold to a person outside Kerala State
the registered owner shall intimate this fact to the registering authority
within whose jurisdiction the transfer is to be effected within 45 days of
transfer and forward the no objection certificate obtained from the registering
authority outside Kerala where the vehicle was previously included.
3) In case of a transport vehicle covered by a permit the vehicle
shall not be sold without obtaining prior sanction from the Regional Transport Authority
for transfer of permit covered by the vehicle
4) The purchaser of a vehicle shall apply for transfer of
ownership within 45 days of the transfer before the registering authority
within whose jurisdiction he has residence or place of business with the
following documents
(a) Two copies of
sale report in form 29
(b) Application in
form 30( part I and part II).
© If the
vehicle is held under any hire purchase or hypothecation or lease agreement one more copy
of form 30 and
no objection certificate from the financier is also needed.
(d) An attested copy of address proof as provided
in CMV Rule 4
(e) registration
certificate in original
(f) Insurance
certificate
(g) Pollution
under control certificate.
(h) receipt of
the fee paid.

This
service can be rendered in fast track counter if the applicant comes in person
and the records will be received back after completing all the processing
within 30 minutes. More details about fast track counters can be obtained from

If the service is not rendered in fast track
counter, as per citizen’s charter the time prescribed for transfer of ownership
is 5 days. That is my after 5 days the registration certificate will be sent to
the applicant by registered post in the address entered in the certificate of
registration after transferring the ownership. It has to be noted that in this
case a self addressed cover with necessary postal stamps affixed for sending by
registered post will have to be submitted by the applicant in addition to the
documents already stated above.

Sir I have one doubt about my vehicle. I bought recently 1993 model bullet. Now I finish all work for renewing the Rc. Rc still old owner name. He signed and gave me all papers. In this case if I am goon myself to renewing Rc they wil accept my request??
If not what I will do??

I have one doubt though, is it required (or advised) that the seller and buyer submit the application for transfer of ownership together at the concerned RT office.
Or can the seller just inform RT office(in Form 29) within 14 days of sale and need not worry about the whether the buyer actually transferred the vehicle in his name.
Though in the act it is stated like that, usually application for transfer of ownership in respect of private vehicles are filed with form 29 two copies and one copy of form 30 part 1 and part 2. For further clarification please call me in 9605933311

ReplyDeleteThe latest fees rates are not known to me. For filing an application for transfer of ownership of a vehicle you will have to go to an akshaya kendra. They will be able to inform you the correct fee. After filing the application online, you will have to take a print out of it and submit the application before the concerned RTO. If the purchaser goes in person before the RTO for this purpose he can ask the officer to
give him the benefit of fast track counter. This is a facility provided for the direct applicants. As per this scheme if an owner of a vehicle or a holder of a license apply directly in person for certain services it has to be completed and given back to the person withing a short period of time. In any case, you can claim for getting the processed RC on the same day.

ReplyDeleteYou can change the ownership of the vehicle in the same way as a vehicle is bought form a third person till your father is alive.
After the death of the owner of a vehicle, transfer of ownership to of the vehicle is governed by different laws and rules.

ReplyDeleteHai Sir, I have sold my car to my relative. The Car purchased by me under vehicle loan. The loan was already closed and I have not received NOC from the financier. Before getting the NOC I have submitted online application for transfer of ownership at mvd.com and remitted the required fee. Now the buyer wants RC book in her name and NOC from the financier within a couple of days. Can you advice how I could get the new RC book and NOC within such a short time

ReplyDeleteWhen the car loan is closed the registered owner will have to apply for cancelling g the hire purchase endorsement in the RC. For this he will have to apply for it before the concerned RTO in form 35(2 copies) and with NOC from financier along with RC book. After cancelling the Hire Purchase, application for transfer of ownership can be given. If both the buyer and the seller are within the jurisdiction of one office, then both these works can be done simultaneously.
