FORM OF AFFIDAVIT SUBMITTED ALONG WITH RMA
APPLICATION



Affidavit filed by………………………………………………. (Name &Address) before the Registering Authority under Section 47 of CMV Act,1988.

I have purchased a Motor Car / Motor Cycle bearing Registration Number…………………with Chassis No………….............and Engine No.........................from Sri/Smt……………………….

(Name & Address) and brought to this State on…………………(In the case of Transfer of Ownership).

The vehicle………………………..stands registered in my name by
Registering Authority…………………………w.e.f……………………Since I  have changed my place of residence to………………………………………………………………………………
………………….and thereby producing the vehicle  to…………………………. office for inspection (In case of Change of  Address).


The following documents also produced: -


  1. Application for assignment for new Registration mark to a motor vehicle in Form 27 duly filled and signed.
  2. NOC in Form 28 with pencil print of Chassis affixed therein issued from registering authority.
  3. Notice of Transfer of Ownership of motor vehicle in Form 29.
  4. Notice of Change of Address in Form 33 with duplicate dully filled and signed.
  5. Application for Intimation and Transfer of Ownership in Form 30 duly filled and signed.
  6. Valid Certificate of Registration.
  7. Valid Certificate of Insurance.
  8. Pollution Under Control Certificate.
  9. Copy of PAN Card or Form 60 declaration (Not needed in the case of 2 wheeler or change of motor car).
  10. Proof of legal presence in India in addition to proof of Residence in the case of foreigners. 


            I hereby solemnly affirm and declare that I am the legal owner of  the vehicle and its above documents and the vehicle are genuine.

            I hereby declare that there are no Departmental or any other action pending against this vehicle and the vehicle is not involved in any theft case.


            I unconditionally hereby undertake that I will be responsible and bound to clear any dues or any other dues or any other actions regarding theft or forged documents if found later on and to suffer any action taken against me relating to this vehicle even prior to the date of  purchase/removal to this State.
           
            To the best of my knowledge and belief, I have not suppressed any facts or information. All facts, information and details furnished above and in the forms and documents produced are true and genuine and
also I undertake to hold myself responsible for any inaccuracy of documents, information and for all kinds of losses to the Government.

  2. I am presently working in Gulf and I am having Gulf License. When I am on a vacation to Kerala Can I use the Gulf License to Drive vehicle or is there any facility to apply for new license based on Gulf License?

    1. Hi,
      With gulf license you cannot drive here. But this will help you to take a new license here. You only have to undergo the learner's licence test and there is no need to wait for the learning period and there wont be any driving test also. There is a special order from the Transport commissioner to issue driving licence to people with license from other countries without any test or learning time.

  4. My company director passed leaving 3 vehicles in his name. He is survived by his wife and two sons aged 23 and 20. Mother and younger son is agreeable to transfer the vehicles in elder son name. RTO is asking for submission of an affidavit signed by mother and younger son saying they have no objection in this transfer. Can you please provide me the format of affidavit.

  5. There is no prescribed format for this purpose. What is needed is a statement in stamp paper from all the legal heirs of the deceased owner signed before a notary public expressing their willingness( no objection) to transfer the ownership of the vehicle/ vehicles to the name of one of the legal heirs deceased owner of the vehicle/vehilces

  8. My vehicle is registered in Port Blair. I have brought the vehicle to Trivandrum and got NOC from RTO, Port Blair in 2019. What are the documents required to change the registration to RTO, Trivandrum. Whether my NOC of Aug 2019 is still valid r needs to be revalidated. Can you share the format of affidavit for the same.
