Termination of hire purchase, lease or hypothecation of a vehicle Kerala RTO



Rule 61 of Central Motor Vehicles Rules, 1989 specifies that an application for making an entry of termination of hire purchase, lease or hypothecation agreement in the certificate of registration of a motor vehicle shall submitted in form 35 in duplicate duly signed by the registered owner of the vehicle and the  financier and shall be accompanied by the certificate of registration and the appropriate fee specified in rule 81 of Central Motor Vehicle Rules, 1989. As per section 51 ©, of Central Motor Vehicle Act, 1988 this application shall be filed before the last registering authority.

The total fee payable for making and entry of termination hire purchase, lease or hypothecation agreement in Kerala State is Rs 200.00 which includes the fee of Rs 100.00 and service charge of Rs 100.00. This service is not rendered at fast track counter as the verification of the genuineness of the form 35 submitted is a time consuming process.

The time allotted for completing the process and sending the registration certificate with an entry regarding the termination of hire purchase, lease or hypothecation agreement to the registered owner in the address entered in the certificate of registration is two days if the financier is within Kerala and thirty days if the financier is outside Kerala as per the citizens charter of motor vehicles department, Kerala.   A self addressed cover with stamps affixed for sending it by registered post will also have to be submitted by the applicant along with the application for      making and entry of termination hire purchase, lease or hypothecation agreement.

               The second copy of the application in form 35 is intended to be sent to the financier by the concerned R.T.O/Joint R.T.O authenticating the fact that an entry regarding the termination of hire purchase, lease or hypothecation agreement had been entered in the certificate of registration and in the records maintained in the office
But due to the heavy work load in the office copy of  form 35  is  not sent by post to the financier.

  

The second copy of the application in form 34 is intended to be sent to the financier by the  concerned R.T.O/Joint R.T.O authenticating the fact that the hire purchase agreement had been noted in the certificate of registration and in the office record . But due to the heavy work  load in the office these forms are not sent by post to the financier.

Renewal of driving license Kerala RTO

                                                           

            Section 15 of Central Motor Vehicle Act, 1988 deals with renewal of license and rule 18 of Central Motor Vehicle Rules specifies the forms and requirements for filing the renewal application.

            A license issued for driving a non- transport vehicle will be valid till the date of completion of 50 years of age of the license holder. A license to drive a transport vehicle will be valid for a period of 3 years only. After the expiry of the validity of a license it can be renewed for further periods, if required by the license holder.  A license for a non- transport vehicle will be renewed for the next 5 years and a license for a transport vehicle will be renewed for next three years if the application for the same Is submitted by the license holder.

         The application for renewal of license can be submitted within 30 days prior to the expiry date or within 30 days after the expiry of the license. In both cases the license will be renewed without any break in the validity of the license. But if the application for renewal of driving license is made 30 days after the expiry of the license, then the license will be renewed only with effect from the date of submission of the application, thereby causing a break in the validity of the license.

           One important thing to take not in this regard is that, renewal driving license will not be allowed after 5 years of expiry of the validity of the driving license. In such a case the license holder has to apply afresh for fresh license and the renewal will be allowed without conducting a driving test. Please see my article on issue of fresh license for further details in this regard.                                                        

           The application for renewal of license has to be submitted before the office of the R.T.O/Joint R.T.O within whose records the license is included at present. The application shall be made in form 9 and in the case of renewal of driving license for non-transport vehicles, a declaration regarding the medical fitness of the applicant in form 1 and an eye certificate in the prescribed format from an ophthalmologist shall also be submitted along with the application. In the case of renewal application of a license for transport vehicles or for persons who are more than 50 years of age a medical certificate in form 1 A is to be submitted in addition to the self declaration of medical fitness in form 1.

           This service can be rendered at fast track counter if the applicant comes in person and the records will be received back after completing all the processing within 30 minutes. Please see my article on fast track counters for getting more details about fast track counters.

          If the service is not rendered in fast track counter, as per citizen’s charter the time prescribed for renewing a license is 5 days. That is my after 5 days the license will be sent to the applicant by registered post in the address entered in the certificate of registration after renewing the license. It has to be noted that in this case a self addressed cover with necessary postal stamps affixed for sending by registered post will have to be submitted by the applicant in addition to the documents already stated above. 
          If the application for renewal of license is made within time as stated above the fee for renewal of license is Rs 300.00. This includes the fee of Rs 250.00 and service charge of Rs 50.00. A late fee of Rs 50.00 per year is payable in case of belated applications.

Hire Purchase noting - Kerala RTO



              An application for making an entry of hire purchase, lease or hypothication agreement in the certificate of registration of a motor vehicle required under sub section (2) of section 51 of Motor Vehicle Act 1988 has to  be submitted before the R.T.O/Sub R.T. O within whose office the vehicle is presently included The application has to be submitted in form 34 in duplicate duly signed by the registered owner of the vehicle and the financier and shall be accompanied by the certificate of registration and the appropriate fee specified in rule 81 of  Central Motor Vehicle Rules, 1989.

         
         

           The total fee payable for noting hire purchase agreement is Rs 175.00 which includes the fee of Rs 100.00 and service charge of Rs 75.00. This service can be rendered at fast track counter if the applicants comes in person and the records will be received back after completing all the processing within 30 minutes.           If the service is not rendered in fast track counter, as per citizen’s charter the time prescribed for noting of hire purchase is two days. That is my after 2 days the documents will be sent to the applicant by registered post in the address entered in the certificate of registration after completing all the processing required.

          The second copy of the application in form 34 is intended to be sent to the financier by the  concerned R.T.O/Joint R.T.O authenticating the fact that the hire purchase agreement had been noted in the certificate of registration and in the office record . But due to the heavy work  load in the office these forms are not sent by post to the financier.




Form and display of registration mark on motor vehicles



Rule 50 of Central Motor Vehicle Rule1989
(1)    On or  after the commencement of this rule, the registration mark referred to in section (6) of section 41 shall be displayed both at the front and at the rear of all motor vehicles  clearly and legibly in the form of security license plate of the following specifications namely,-
(i)                 the plate shall be a solid unit made of 1.0 mm aluminum conforming to DIN 1745/DIN 1783  or ISO7591. Border edges and corners of the plate shall be rounded to avoid injuries to the extent of approx. 10 mm and the plates must have an embossed border. The plate shall be suitable for hot stamping and reflective sheet has to be guaranteed for imperishable nature for minimum five years. The fast colouring of the legend and border to be done by hot stamping;
(ii)               the plate should bear the letters “IND” in blue colour on the extreme left center of the plate. The letter should be one fourth of the size of the letters mentioned in Rule 51 and should be buried into the foil or applied by hot stamping and should be integral part of the plate;
(iii)             each plate shall be protected against counterfeiting by applying chromium based hologram, applied by hot stamping. Stickers and adhesive labels are not permitted. The plate shall bear permanent consecutive identification number of minimum seven digits, to be laser branded into the reflective sheeting and hot stamping film shall bear a verification inscription;
(iv)              apart from the registration marks on the front and the rear, the third registration mark in the form of self destructive type, chromium based hologram sticker shall be affixed on the left hand top side of the wind shield of the vehicle. The registration details such as registration number, registering authority etc. shall be printed on the sticker. The third registration mark shall be issued by the registering authority/approved dealers of the license plates manufacturer along with the regular registration marks, and thereafter if such sticker is destroyed it shall be issued by the license plate manufacturer or his dealer;
(v)                the plate shall be fastened with non-removable / non-reusable snap lock fitting system on rear of the vehicle at the premises of the registering authority;
      The license plates with all the above specifications and the specified registration for a vehicle shall be issued by the registering authority or approved license plate manufacturer or their dealers. The Central Road Research Institute, New Delhi or any of the agency authorized by the Central Government shall approve the License plate manufacturers to the above specification;

(vi)              the size of the plate for different categories of vehicles shall be as follows:-

     For two and three wheelers                                              200 x 100 mm
     For light motor vehicles/passenger cars                           340 x 200 mm/
500 x 120mm
                                    For medium commercial vehicles, heavy commercial                   340 x 200 mm
                                 vehicles  and Trailer combinations          
                                Provided that this sub rule shall apply  to already registered vehicles two years from the date of commencement.
[Provided further that the size e of registration plates for agricultural be tractors shall be as follows:-
                Front                                                                                                     285 x 45 mm
                Rear                                                                                                       200 x 100 mm]
(2)    In case of any motor cycles the registration mark in the front shall be displayed parallel to the handle bar on any part of the vehicle including mudguard facing the front instead of, on a plate in line with the axis of the vehicle.

Provided that:-

(a)    The registration mark exhibited at the rear of a transport vehicle shall be affixed in the vehicle to the vehicle on the right hand side at a distance not exceeding one meter from the ground as may be reasonably possible having regard to the type of the body of the vehicle
(b)   The registration mark shall also be painted on the right and left side on the body of the in the case of a transport vehicle.

(c)    The registration mark shall also be painted and exhibited on the partition provided between the driver and passengers, facing the passengers seats or where there is no such  partition, on the front interior of the vehicle near the roof to the left side of the driver’s seat  facing the passengers’ seats in the case of a stage carriage or contract carriage and In the case of a motor cab or a taxi cab it shall be sufficient if the registration mark is  painted on the dash board;

(d)   the letters of the registration mark shall be in English and the figures shall be in Arabic numerals and shall be shown:-

(A)   in the case of transport vehicles in Black colour on Yellow background; and
(B)   in other cases, in Black colour on White background

the registration mark on trailer shall be exhibited on the left hand side in Black colour on Yellow background. In addition, the registration mark on the drawing vehicle shall be exhibited on the trailer also and this shall be done on the right hand side at the rear of the trailer or the last trailer as the case may be, in Black colour on retro-reflective type yellow background;

Provided that where provision of this clause have not been complied with in respect of motor vehicles, on or before the commencement of the Central Motor Vehicles (8th amendment) Rules 2001, then provisions shall be complied with:,-
(i)                   in respect  of transport vehicles on or before 1st February 2002, and   
(ii)                In other cases, on or before 1st July 2002

(3)    The registration mark in shall  be exhibited in two lines, the  State code and registering authority code forming the first line and the rest  forming the second line one below the other:

Provided that the registration mark in  the front may be exhibited in a one line.        

Provided further that in models of two vehicles having no sufficient provision at the rear to exhibit registration mark in two lines, it shall be sufficient in such vehicles that the registration mark is exhibited in a single line:

Provided further that the registration mark on a light motor vehicle may be in the center with illumination.

(4)     Every motor vehicle, except motor cab and motor car, manufactured on and from the date of commencement of the Central Motor Vehicles (Amendment) Rules, 1993, shall be provided with sufficient space in the rear for display of registration make in tow lines’
(5)    In case of agricultural tractors, the registration mark need not be inclined to the vertical plane by more than 45 degrees.
(6)    The registration mark of the drawing agricultural tractor may not be exhibited on the agricultural trailer or trailers.

Driving by a drunken person or under the influence of drugs



Section 185 of the Motor Vehicles Act, 1988
Whoever, while driving, or attempting to drive, a motor vehicle: -
(a)    has, in his blood, alcohol exceeding of 30 mg. per 100 ml of blood detected in a test by a breath analyzer;  or
(b)   is under the influence of a drug to such an extend as to be incapable of exercising proper control over the vehicle
shall be punishable for the first offense with imprisonment for a term which may extend to six months, or with fine which may extend to two thousand rupees, or with both, and for a second or subsequent offense, if committed within three years of commission of the previous similar offense, with imprisonment for a term which may extend to two years, or with fine which may extend to three thousand rupees or with both.
Explanation:- For the purpose of this section, the drug of drugs specified by the Central  Government in this behalf, by notification in the Official Gazette, shall be deemed to render a person incapable of exercising  proper control over a motor vehicle.

Issue of duplicate certificate of registration



When the certificate of registration of a motor vehicle has been lost irrecoverably, the owner of the vehicle can apply for duplicate registration certificate to the R.T.O/Sub R.T.O within whose office records the vehicle has been included. The application for duplicate registration certificate shall be filed in form 26. Before filing the application for duplicate registration certificate, the applicant has to inform the concerned Sub Inspector of police about the missing of the original registration certificate and a certificate stating the missing of registration certificate is being enquired into has to be obtained from that station and the certificate has to be submitted along with the application for duplicate registration certificate.
On receipt of the application the concerned R.T.O will give you the specimen of a matter which you will have to publish In a leading local daily. After 15 days of publishing the matter in a daily, you will have to appear for a personal hearing before the R.T.O/Joint R.T.O who has issued the matter for publication and after hearing you and ascertaining the circumstances which led to the loss of the registration certificate, duplicate registration certificate will be issued by the concerned R.T.O/Joint R.T.O.
